MINNEAPOLIS — The pharmaceutical industry, ever mindful of its bottom lines, sued the State of Minnesota to overturn a new law mandating that drug-makers provide emergency insulin to diabetics who can’t afford the life-saving drug. The Pharmaceutical Research and Manufacturers of America, also known as PhRMA, claimed the state is stealing drug companies’ profits by requiring them to provide insulin for free. Pharma claims the law violates the U.S. Constitution’s ban against government confiscation of private property without reimbursement, in this case insulin. Pharma lobbyists had used the constitutional argument while the Legislature was sorting through options to assure diabetics had access to insulin.
