The attorney said the judge abused his discretion by keeping the trial in Minneapolis. where, he said, news coverage was persuasive and prejudicial. The attorney, Eric Nelson, also claimed the publicity has a “far-reaching chilling effect” on his ability of defendants to get expert witnesses. “The publicity here was so pervasive and so prejudicial before and during this trial that it amounted to a structural defect in the proceedings,” Nelson wrote.
