MADISON, Wis. – The Wisconsin Supreme Court ruled 4-3 that Governor Tony Evers does not have the authority to issue capacity limits on bars, restaurants and other businesses without approval of the Legislature. Evers’ Department of Health Services imposed on-again, off-again capacity restrictions as recently as October to curb Covid transmission. The last order was 25% of fire marshal maxes for indoor occupancy or 10 people for places without a fire marshal occupancy limit. The rule was challenged by the Mix-Up Bar in Amery and Pro-Life Wisconsin.
