MANKATO, Minn. – The judge rejected Maddi Kingsbury’s diary as evidence in the trial of Adam Favel, her live-in companion and the father of their children, who is accused of her murder. Judge Nancy Buytendorp sided with an argument that the diary was irrelevant. The diary also had been challenged as perhaps not even being Kingsbury’s – even though it was found in her bedroom and contained several pages written to her pre-school daughter, apparently intended to be read some years int the future. Doubts were cast about whether the diary legally was hearsay. Anoter argument was that the diary had nil value for ourposes of the of the trial. In the diary, according to sources, Kingsbury talked about her relationship with Fravel and expressed jealousy of couples in loving relationships. The diary, according to one side, offered “a full picture of Kingsbury and who she was.” The debate over the diary, called Evidence Z. took 45 minutes. The debate mirrored motions last week over search histories on Kingsbury’s phone to pornographic sites. Judge Buytendrop allowed the phone histories into evidence for the jury to consider.
