ST. PAUL, Minn. – The Minnesota Supreme Court overturned the third-degree murder conviction of a Minneapolis police officer who fatally shot a woman who had called 911 to report a possible rape behind her home. The Supreme Court said the third-degree murder conviction required that there be a depraved-mind which, the Court said, was not the case with officer Mohamed Noor. He had been convicted in the 2017 death of Justine Ruszczyk Damond, an Australian who called 911. Noor responded and shot Damond by mistake. He was sentenced to 12 1/2 years. The new Supreme Court ruling means that Noor’s sentence must be reviewed and limited only to a manslaughter count.
