ST. PAUL, Minn. — Secretary of State Steve Simon won’t fight a federal appellate decision that went against extending the deadline for November 3 ballots to be extended – for now anyway. A split 2-1 by the 8th Circuit ordered that ballots received after 8 p.m. on election day be set aside for perhaps further court deliberation. Simon noted that the ruling did not declare the ballots invalid. Said Simon: “We absolutely reserve the right to make every argument after Election Day that protects voters.” In the meantime, he encouraged voters to cast their ballot by 8 p.m. on November to assure they’re counted.”
